2. Spotsylvania County to consider changing discharge ordinance on Tuesday, January 8th!

Spotsylvania County will be holding a public hearing on January 8, 2013 at 6:30 PM to ALLOW discharging firearms on 5 acre and larger subdivision lots and to define what a subdivision is. Currently, you cannot discharge a firearm in a subdivision except for self defense purposes but subdivisions are never defined.
We need people, especially Spotsylvania County residents, to come out and SUPPORT the revised ordinance!
When originally floated, the proposed revision would allow shooting on lots 1 acre and larger. Concerns were raised that 1 acre is too small and now the minimum lot size is 5 acres. Is 5 acres a good size? Would 4 acres be too small? 3 acres? Let's fight to get as good an ordinance as we can.
Someone will be handing out Guns Save Lives stickers.

Host of gun bills await legislators in upcoming session

Gov. Bob McDonnell has established a task force to review school and campus safety in Virginia after the mass shooting in Connecticut. He has ordered the group to send him its initial recommendations by Jan. 31 so that he and lawmakers can consider the ideas in the General Assembly session that starts Jan. 9.
A separate work group, headed by Attorney General Ken Cuccinelli and Dr. Bill Hazel, the state's secretary of Health and Human Resources, is reviewing issues related to mental health.
While lawmakers have until Jan. 19 to introduce bills for the upcoming session, legislators in both parties already have announced or introduced a host of gun bills. For example:
• Del. Joseph D. Morrissey, D-Henrico, says he will introduce legislation to ban the sale of assault-style weapons and large-capacity magazines.
• Sen. David W. Marsden, D-Fairfax, has introduced legislation to make gun owners civilly liable if their weapons are stolen and used in the commission of a crime that results in death or injury and they "failed to take adequate care and control" to prevent the theft. He filed a second bill that would establish a $250 penalty for failing to report the theft of one's gun.
• Republicans in the House of Delegates say they want to boost funding to encourage more school resource officers in elementary schools. School resource officers are certified local law enforcement officers who are posted in public schools in the state. Terry McAuliffe, the presumptive Democratic nominee for governor, has called for legislation to help localities provide school resource officers for elementary schools that request it.
• Del. Robert G. Marshall, R-Prince William, says he will introduce legislation that would require school boards to arrange for some school employees to receive the Virginia State Police standard of firearm safety and competency training.
• Del. Anne B. Crockett-Stark, R-Wythe, has filed a "castle doctrine" bill that would provide civil immunity for people who use deadly force against an intruder.
• Sen. Janet D. Howell, D-Fairfax, says she will introduce legislation to close the so-called gun-show loophole in which private purchasers can buy guns from private sellers without undergoing a background check.
• Del. Luke E. Torian, D-Prince William, has introduced a bill that would delete some firearms safety courses that now satisfy the competency requirement to qualify for a concealed-weapon permit. The bill requires that certain firearms safety courses that satisfy the requirement focus primarily on the use and handling of a concealed handgun.
• Del. James M. Scott, D-Fairfax, has introduced a bill that would bar any person who is convicted of stalking, sexual battery, or assault and battery of a family member that results in serious bodily injury from possessing, transporting, or carrying a firearm or any other weapon for five years after conviction.
• Sen. Phillip P. Puckett, D-Russell, introduced a bill that provides an exemption for any retired correctional officer with at least 15 years of service from any fee charged for the issuance of a concealed-handgun permit.

6. VCDL joins gun rights coalition to fight gun control at federal level and coordinate at local levels

VCDL has joined a coalition of gun rights organizations (19 national and state organizations) to fight and defeat the new gun-control legislative threats from the federal government. The group is called the National Coalition to Stop the Gun Ban and takes a "no compromise" stand, regardless of what positions other gun groups might take. It will focus on un-electing legislators who support gun control.

In coming weeks, you will face pressure from the Obama administration and others to implement a ban on semi-automatic firearms and certain ammunition feeding devices, and to pass laws requiring private gun transfers to be processed via the National Instant Check System.
Yet the "assault weapon" misnomer is a myth perpetuated by gun control advocates who seek to confuse the public about the difference between millions of semi-automatic firearms, which are functionally identical to hunting rifles, and military "assault rifles," which are machine guns virtually unavailable to the public since implementation of the National Firearms Act of 1934.
The truth about modern rifles
The modern rifles Senator Dianne Feinstein has, by her own admission, waited decades to ban differ from others primarily by cosmetic features such as barrel shrouds, threaded barrels, flash suppressors, pistol grips and adjustable stocks – things which do not affect function. The notion being promulgated by gun control advocates that such features increase lethality by allowing guns to be "fired from the hip" is absurd: Any firearms expert will attest that rifles can only be effectively utilized from the shoulder.
Although you are being told that ammunition used by modern rifles is excessively destructive, in truth it is ballistically inferior to common .30-06 hunting ammunition and was selected by the military not for its lethality, but instead for light weight and low recoil.
And when you hear how "high capacity" magazines increase mortality in mass shootings, understand that Seung-Hui Cho carried no fewer than nineteen magazines for the Virginia Tech rampage, and that nearly all mass murderers who use guns carry multiple firearms, rendering magazine capacity moot. Like the misnomer "assault weapon," the "high capacity" designation of more than ten rounds for magazines represents nothing more than an arbitrary limit set on devices which have been in common possession since the early Twentieth Century.
Moreover, attempts to process private gun sales through the National Instant Check System represent nothing less than a stepping stone to national gun registration; under the Clinton administration, the FBI retained NICS transaction records in violation of the Brady Act, creating a defacto national registration system.
Most outrageous, however, is Sen. Feinstein's proposal to regulate "grandfathered" modern rifles under the National Firearms Act. Doing so would not only entail registering millions of existing firearms, but would represent unprecedented expansion of police powers through the BATFE by requiring millions of gun owners to be fingerprinted and photographed like common criminals. Because a large percentage will refuse to comply, the scheme, if implemented, will make felons of otherwise law-abiding citizens.
Semi-auto ban: No impact on violence
Neither have such laws been effective. From 1994 to 2004, the previous ban on semi-automatic firearms and magazines had no impact on school shootings, which actually increased during that period. Indeed, some of the worst school shootings, including Columbine High School, took place during the ban.
Despite predictions from gun control advocates that violent crime would increase after the ban expired, it has actually dropped: According to FBI Uniform Crime Reports, between expiration of the ban in 2004 and the most recent for which data is available (2011), violent crime dropped by 17% and homicide, by 15%.
Meanwhile, weapons use in homicide has remained unchanged and, significantly, use of rifles (including those targeted for bans) declined slightly from 2.7% of homicides in 2004 to 2.5% of homicides in 2011. Clearly, rifles of any type, including those with features targeted by semi-auto bans, are rarely used in crimes.
'Gun Free School Zones Act' increased killings
What does appear to have impacted school shootings was implementation of the latest version of the "Gun Free School Zones Act" (GFSZA), which is associated with a dramatic increase in school murders.
Between the first significant school shooting, in 1966, and enactment of the 1996 GFSZA, media summaries reveal 8 shootings with 134 victims killed or wounded – a rate of 4.3 victims per year. Between 1996 and 2012, the review finds 62 shootings and 367 victims – a fivefold increase to 23 victims per year. Yet, during the same period, FBI Uniform Crime Reports indicate homicide nationwide dropped by 14%.
While media summaries may not be comprehensive, the GFSZA has clearly been an abject failure. Worse, evidence suggests it may actually create "kill zones" which attract violent predators.
Researchers John Lott and William Landes, then at Yale and the University of Chicago, respectively, studied multiple victim public shootings. Said Lott, "Gun prohibitionists concede that banning guns around schools has not quite worked as intended—but their response has been to call for more regulation of guns. Yet what might appear to be the most obvious policy may actually cost lives. When gun-control laws are passed, it is law-abiding citizens, not would-be criminals, who adhere to them."
Examining data from 1976 to 1995, they discovered that mass homicides in states adopting concealed handgun laws declined by 84%, deaths plummeted by 90% and injuries by 82.5%. Crediting the reductions to deterrence (even suicidal maniacs avoid armed victims), Lott and Landes called their findings "dramatic," concluding: "[T]he only policy factor to have a consistently significant influence on multiple victim public shootings is the passage of concealed handgun laws."
Coalition position
Members of the National Coalition to Stop the Gun Ban demand that Congress refuse to use lawful gun owners as political scapegoats and instead reduce school violence by:
· Defeating any attempt to pass gun control including, but not limited to, banning semi-automatic firearms or magazines, or requiring private gun transfers to be registered through the National Instant Check System; and
· Repealing the Gun Free School Zones Act of 1996.
No 'compromises'
Some will urge you to "compromise," perhaps even the National Rifle Association. The many thousands of gun rights supporters represented by the Coalition, however, regard "compromise," as our opposition defines it, to be a process in which we lose slightly fewer of our rights than under the original proposal. Consequently, any legislation which registers or bans firearms; limits magazine capacity; registers private transactions through NICS; or restricts time, place or manner of self-defense is unacceptable.
Members of Congress who support gun owners by opposing all gun control will, in turn, benefit from support by Coalition organizations. Members of Congress who support gun control by any means, procedural or substantive, will be targeted for defeat by Coalition members. They will be subject to picketing, leaflet drops at events in their districts, phone and mail campaigns, and political action committee opposition. NRA ratings and endorsements will have no impact on Coalition actions.
In coming weeks, we look forward to working with you to reduce school violence by allowing lawful citizens in schools and elsewhere to defend themselves against violent predators.

Kaul: Nation needs a new agenda on guns
This time, the debate has to be about more than not offending the NRA's sensibilities.

I'm glad I retired five months ago.
Think of it: I was spared writing about the presidential election, an event so vacuous it made reality TV seem interesting. If there was any serious discussion of an important national issue — global warming, obesity, transportation policy, the morality of drone attacks on civilian populations, the environmental consequences of fracking, existential implications of the designated hitter — I missed it.
Instead, we got a campaign of misrepresentations, exaggerations and outright lies. The Republicans were by far the worst offenders, but President Barack Obama didn't cover himself in glory either.
I was happy with the result of the presidential election, but I didn't regret not covering it. And I was entirely content to go on not writing about things. (If I could make a living at that, life would be perfect.)
But then Newtown happened. A misanthropic young man who never seemed particularly violent killed his mother then broke into an elementary school and massacred little kids, teachers and the principal.
And the very air changed. The holiday season suddenly turned somber. You looked at the small children around you differently, as fragile, precious gifts to be cherished and, above all, protected.
Obama struck that note in his moving speech at the memorial service. Speaking for us all, he said: "We can't tolerate this anymore. These tragedies must end. And to end them, we must change."
Nice words, but somehow not enough. Not nearly enough.
That's when I figured I should write a column about it. During my 50-year career, every time some demented soul would take a semiautomatic gun and clean out a post office, a school or a picnic, I'd get up on my soap box and let loose with a withering diatribe about guns, the National Rifle Association and weak-kneed politicians. Did it about 75 times, give or take.
And in every case the main effect was a spike in gun sales.
Still, I thought I'd give it one more shot ... er, chance.
Obama's speech was fine as far as it went, but it didn't go very far. Neither have any of the other responses I've heard.
California Sen. Dianne Feinstein said she was going to introduce a bill to ban the sale and importation of assault weapons. Great, but the bill wouldn't apply to weapons already out there, and in defining illegal weapons, it listed more than 900 exceptions.
Nine hundred!
The thing missing from the debate so far is anger — anger that we live in a society where something like the Sandy Hook Elementary massacre can happen and our main concern is not offending the NRA's sensibilities.
That's obscene. Here, then, is my "madder-than-hell-and-I'm-not-going-to-take-it-anymore" program for ending gun violence in America:
• Repeal the Second Amendment, the part about guns anyway. It's badly written, confusing and more trouble than it's worth. It offers an absolute right to gun ownership, but it puts it in the context of the need for a "well-regulated militia." We don't make our militia bring their own guns to battles. And surely the Founders couldn't have envisioned weapons like those used in the Newtown shooting when they guaranteed gun rights. Owning a gun should be a privilege, not a right.
• Declare the NRA a terrorist organization and make membership illegal. Hey! We did it to the Communist Party, and the NRA has led to the deaths of more of us than American Commies ever did. (I would also raze the organization's headquarters, clear the rubble and salt the earth, but that's optional.) Make ownership of unlicensed assault rifles a felony. If some people refused to give up their guns, that "prying the guns from their cold, dead hands" thing works for me.
• Then I would tie Mitch McConnell and John Boehner, our esteemed Republican leaders, to the back of a Chevy pickup truck and drag them around a parking lot until they saw the light on gun control.
And if that didn't work, I'd adopt radical measures. None of that is going to happen, of course. But I'll bet gun sales will rise.

15. Why background checks on private sales must not be allowed to happen

Every now and then we get some new members who don't understand the threat behind having background checks for private sales. So I will repeat here what I sent to somebody a few days ago:
There is a good reason NOT to require private sales to have background checks - it is called "registration." The government will know exactly which guns you have because you cannot sell or buy one without getting their clearance. Right now, they don't know for sure what guns you have or don't have. That makes confiscation hard, if not impossible. Background checks would not have stopped any of the massacres that have happened. And a straw purchase, where someone with a clean record buys a gun for a criminal, makes them ineffective, even if private sales required background checks. Don't buy into the anti-gun rhetoric about background checks or the lie that gun shows have some kind of "loophole."

22. Code Pink gets a belly-laugh from gun owners outside of Chantilly gun show last weekend

At the Chantilly gun show on Friday night, a handful of protesters from Code Pink were protesting gun rights. Their leader was chanting through a megaphone. At one point she and her fellow Codes were chanting "BAN assault weapons!" and the gun owners in line near them chanted back, "BUY assault weapons!" ;-)
Wait - it gets better!
Then Ms. Pink (?) chants, "Ban high-velocity magazines!"
At that point the gun owners all broke into belly-laughs. Ms. Pink (or whatever her name is) at that point was clearly shaken by the laughter. Having no idea what she said wrong, she put the megaphone down for five-minutes before getting the nerve to go back into her chanting again.
Shortly thereafter her group was evicted to the public sidewalk and the chanting, thank heavens, soon became but a funny memory.

Congressman Goodlatte tells Capitol Hill publication that he won't support stricter gun laws
WASHINGTON, D.C.—
Congressman Bob Goodlatte told the Capitol Hill publication "Roll Call" that he would not support tightening gun control measures.
"We're going to take a look at what happened there and what can be done to help avoid it in the future, but gun control is not going to be something that I would support," Goodlatte was quoted as sayingin Roll Call.
Goodlatte was recently elected as the chairman of the House Judiciary Committee. His chairmanship begins in January. Goodlatte represents the 6th Congressional District, which is in the WDBJ7 viewing area.
Gun control has been a hot-button issues in the wake of Friday's shootings in Connecticut.
Goodlatte's office released the following statement Tuesday about the Connecticut shootings:
"Our hearts and prayers as a nation are with the community of Newtown and the families of the victims as they mourn the lives lost in this senseless act of violence. We must take a close look at what happened last week. I will listen to and carefully review suggestions made by the President's task force and other groups to see what we can do to prevent a terrible tragedy like this in the future."

The District of Columbia's city council voted unanimously on Tuesday to decriminalize inadvertently violating the city's unique gun laws. The liberal council surprisingly moved forward with the schedule vote, despite the national calls for more gun-control laws in the wake of the tragic Sandy Hook Elementary mass murder Friday in Newtown, Conn.
The new law gives the prosecutor the option of using administrative disposition for unregistered firearm or unregistered ammunition offenses. A violator would be then be given a fine (to be determined by the court) but no criminal record. This only applies to people who aren't charged with another crime during the same event.
The current penalty for possessing unregistered guns or ammo is up to $1,000 fine and a year in jail.
This new policy is for residents and tourists alike. Originally the bill only only applied to nonresidents, as the council thought it reasonable that they would not know about the District's extreme firearms laws. In committee, this was challenged by lawyers who said that Americans can't be charged different for breaking the law.
City Council Chairman Phil Mendelson amended the bill before final passage in order to make it universally applicable. However, the prosecution will be able to take into account whether the person was a resident at the time of arrest and "had knowledge of" the gun laws. The change will go into effect after Mayor Vincent Gray signs it and the 30-day congressional review period passes.
After the 7th U.S. Circuit Court of Appeals overturned the Illinois ban on carry rights, the nation's capital became the only place in the country where Americans are denied their constitutional right to bear arms. The city requires that every single gun be registered with the police. In addition, D.C. only allows those with a registered gun to possess ammunition.
In the hearing on this legislation in September, Mr. Mendelson read aloud the stories I'd written on war veterans Army 1st Lt. Augustine Kim and Spec. Adam Meckler, who both went to jail for gun crimes.
Lt. Kim was legally transporting his guns in 2010 from his parents' home to his own in South Carolina, but he stopped in D.C. for a doctor's appointment related to injuries suffered while in Afghanistan. At a traffic stop, the police arrested him and charged him with four felony counts of possessing unregistered guns (which were locked in the trunk), threw him in jail overnight and confiscated his guns for two years. Army Spc. Adam Meckler went to the VFW building in D.C. to turn in some forms as he was leaving active duty. The veteran of the wars in Afghanistan and Iraq had forgotten about some loose rounds of ammunition at the bottom of his backpack. Spc. Meckler was handcuffed, arrested and ended up accepting a plea deal, which he now regrets. (Click here to read Spc. Meckler's story.)
Both Spc. Meckler and Lt. Kim cooperated with me because they believed that putting aside their own shame about having a criminal record (Lt. Kim's deal cleared his name after a year) was worth it in order to help others avoid making the same mistake. Today they have been given the only reward they asked for, which is helping other responsible and law-abiding gun owners avoid getting tangled in Washington's crosshairs.

Part of my job is to work with the press. Sometimes that means working with some of the more hostile papers. I spent over an hour being interviewed by a Style Weekly reporter, covering a vast range of subjects. With such a broad interview, you never know what is going to come out of it. A few of my responses to the reporter's questions were given much more significance than I thought they deserved (like about machine guns). Clearly the reporter had an image he wished to paint as he picked and chose through that long interview. But some of the more important points I made are in the article, too - such as allowing CHP holders to carry in schools.
And because of that article, I learned why Andrew Goddard's hair is becoming more curly! ;-)
