[Peninsula-Patriots] Grants vs Gun Rights HB2340

So what is more valuable to you - protecting your right to keep and bear arms or the state getting small grants from the federal government?

Well, according to House Majority Leader, Delegate Kirk Cox of Colonial Heights, and a majority of Republicans and Democrats, the money is more important!

This all centers around Delegate Bob Marshall's pro-gun bill HB 2340, which would prohibit any state or local government employee from assisting the federal government with enforcement of any federal gun laws or Presidential Executive Orders made after 12/31/12.

Bottom line:  if Congress passes, say, a ban on 30-round magazines, the federal government would have to enforce it completely on their own, with no help from any state or local government employee or agency.  That would put a major damper on enforcement of any such law.  It's really simple:  if the feds pass an unconstitutional gun law, they get to enforce it all on their own.

Sounds good, right?  Ah, but, the opponents, like Kirk Cox say, "What if the feds stop giving our law enforcement grant money and what if our police can't participate in federal task forces?"

Honestly, I could care less about grants and federal task forces.  My freedom and yours is not for sale at any price.  Period.  And absolutely not for some stipend from Uncle Sam.  That stipend, by the way, is our own money being handed back to us as a "favor."

Shamefully, Delegate Cox led the anti-gun fight to have HB 2340 sent to the House Appropriations Committee at this late date with the hopes of killing it.  You know how that goes, we wanted to hear that bill in Appropriations, but, darn, we just ran out of time!"

The choreography began with anti-gun Delegate Toscano, a Democrat, moving to outright kill the bill.  A recorded vote on this motion was taken, giving those who wanted to kill the bill in a more stealthily manner cover by allowing their good vote to be seen.  Here are those who cast an ANTI-GUN VOTE in favor of Toscano's motion to outright kill HB 2340:

Albo, BaCote, Brink, Bulova, Carr, Comstock, Dance, Filler-Corn, Herring, Hester, Hodges, Hope, Howell, A.T., James, Keam, Kory, Krupicka, Lewis, Lopez, McClellan, Morrissey, Plum, Scott, J.M., Sickles, Spruill, Surovell, Torian, Toscano, Tyler, Ward, Ware, O., Watts

Toscano's motion failed.

The next dance move was by Delegate Kirk Cox, who was so very concerned about losing some droppings from the federal teat, that he made a speech extolling the wonders of sending HB 2340 to the Appropriations committee.  Delegate Putney then made the anti-gun motion to send HB 2340 off to the House Appropriations Committee (to die for lack of attention).  Forget that the bill itself would actually save the state money by not having to pay our police for their time running around with the feds.

On this motion, and not by mistake, only a voice vote was taken, making it difficult to hold the delegates accountable for bad votes.  Delegate Bob Marshall made a motion to get a recorded vote, but could not even garner the necessary 20 votes to do so!  That means we have a bunch of bad votes and we need to hold those who made them accountable come election time THIS NOVEMBER.

To save HB 2340 and to hold those with anti-gun votes accountable, we need to take the following two steps:

We need to FLOOD the email boxes of the House Appropriations Committee with thousands of emails, NOW.  We need to tell them to report HB 2340 out of the committee and back to the House Floor.

HB1430 passed the House Committee on Agriculture, Chesapeake and Natural Resources with a re-enactment or delayed enactment clause for July 1, 2014. This means if the bill makes to the Governor's desk for his signature in this session, it must once again pass both houses and be signed into law in 2014 before it will be effective.

HB2012 to place a moratorium of drones for a year passed the House House Courts of Justice Sub-Committee: #1 Criminal with the following amendments:

 

  1. The moratorium is for two years rather than one, extending it to 2015.

  2. Provides the Governor with use of drones in the event of an emergency.

 

YEAS--Bell, Robert B., Cline, Gilbert, Villanueva, Morris, Watts, Herring--7.

 

NAYS--Albo, Miller--2.

 

In May of last year, Governor McDonnell praised drone technology saying they are "great" and urged its use domestically for the same reasons it is deployed overseas.

 

Governor McDonnell should be held to the same standard as law-enforcement when it comes to unwarranted surveillance with the use of an unmanned drone. But McDonnell made it clear that he believes drones should not only be used domestically for surveillance, but to be used for the same reasons they are deployed overseas.

 

The Commonwealth of Virginia is not a combat zone. Why would any Governor be allowed to use armed unmanned drones against the citizens of Virginia?

 

Obama would be proud!

 

This is unacceptable and our legislators in the House need to hear our outrage loud and clear!

 

The bill is on its way to the full Committee on Courts of Justice and their next meeting is Friday, February 1, 2013.  

 

Please contact members of the committee and urge them to strike the provision that the Governor would have use of armed unmanned drones under any circumstances from HB2012.

 

We have a President with a kill list and weaponized drones at his disposal and he is all too willing to use them for whatever reason he sees fit. We don't need a Governor with them, too.

 

Tell them that the use of weaponized drones domestically is an act of war against the citizens of the Commonwealth.  

 

Law-enforcement has helicopters and planes at it's disposal in case of emergencies and drones are for combat, not domestic use.

Dear Friend of Liberty

Lawmakers in Richmond are caving to the pressures of the Virginia Farm Bureau, VACo, and Fauquier County Supervisors. VFB said the Boneta Bill, HB1430, should have been discussed with them before it was introduced.

Since when did they become the decision-makers on what rights will be protected?

At the request of Matt Lohr, Virginia's Commissioner of Agriculture, Delegates Robert Orrock and Daniel Marshall moved to add a re-enactment clause to HB1430.

What this means is if the bill passes and is signed by the Governor in this session, it must also pass and be signed into law in the 2014 session before it takes effect.

Delegate Orrock explained to the room packed with supporters of the bill that this issue is so important they "need the extra time to be sure to get it right". How much better can it be for bureaucrats and special interests than to have more time to strategize how they will hold on to their power?
If only lawmakers would take such care in passing laws that violate our rights!

Please call Delegate Robert Orrock at (804) 698-1054 and Delegate Daniel Marshall at (804) 698-1014 and tell them to replace the re-enactment clause with an enactment clause that would make the bill effective July 1, 2013.

Tell them farmers have been stepped on long enough by corporate special interests and over-reaching local ordinances. Waiting another year will mean less profits for farmers and more farms will fail.

Tell them to stop caving to the pressures of the VFB, VACo and Fauquier County bullies.

Please call Delegate Orrock at (804) 698-1054 and Delegate Marshall at (804) 698-1014 today!

Then contact your representative in the House and urge them to support replacing the re-enactment clause with an enactment clause to become effective July 1, 2013 when this bill comes to the House floor.

This re-enactment clause cannot stand! The rights of farmers to sell their produce and other agricultural goods can not wait another year and must be protected now!

Gun1Gun Rights HB2340

Dear 2nd Amendment Supporters: 

 

My HB 2340, which says Virginia law enforcement and the National Guard will not enforce any new federal gun control efforts, was to be voted on by the full House of Delegates today.  However, the House of Delegates shamefully voted to send my HB 2340 to the Appropriations Committee with a non-recorded vote to look into "concerns" that Virginia might lose federal grant money for Joint Task Forces as a result of this bill.  This is simply not true!  

 

HB 2340 will not prevent a state or local official from participating in such task forces or from aiding a federal official in an investigation related to a federal crime such as kidnapping across state lines, or a drug operation just because the person being investigated happened to be in possession of a firearm made illegal through new Federal gun controls.  As such there should be no reason for the Federal government to withhold funding for such Task Forces. What HB 2340 WILL DO is give Virginia a leg to stand on in opposing new Federal gun control legislation. 

 

On the floor today I equated failing to protect the Second Amendment rights of our citizens to accepting 30 pieces of silver from the Federal Government in exchange for a fundamental right. 

 

Delegate Kirk Cox (R-66) raised the objection about losing Federal funding but when questioned could not point to any funding that has been lost as a result of HB 1160 which became law July 1, 2012.  

 

HB 1160 was very similar to HB 2340 with regard to the method used to stand against the Federal Government's intrusion into the Constitutional rights of Virginia citizens.  In that case the bill was to keep Virginia from assisting the Federal Government in detaining citizens with no trial and no charges filed under the NDAA.  To my knowledge no funding has been withheld by the Federal Government as a result of HB 1160 becoming law and none would be withheld as a result of HB 2340. 

 

I requested a record vote on the motion to refer the bill to Appropriations, but could not even find the necessary 20 members willing to second my demand for a record vote.  I asked for a division which resulted in an overwhelming number of Republicans raising their hands (in addition to the Democrats, of course) to send the bill to the Appropriations Committee.  I could only identify 4 other members who voted not to send the bill to Appropriations, Delegates Mark Cole, Todd Gilbert, Scott Lingamfelter and Tony Wilt.  If the Appropriations Committee fails to take the bill up or make a motion on the bill, every member must be held accountable because silence on HB 2340 is consent to an agreement with federal efforts to abridge our Second Amendment rights.  

 

PLEASE CONTACT THE MEMBERS OF THE APPROPRIATIONS COMMITTEE BELOW AND URGE THEM TO ACT WITHOUT DELAY TO SEND HB 2340 TO THE FULL HOUSE OF DELEGATES FOR A VOTE BEFORE CROSSOVER, OR HB 2340 WILL BE KILLED AND VIRGINIA WILL BE LEFT WITH NOTHING TO PROTECT IT'S CITIZENS FROM NEW FEDERAL GUN CONTROL LAWS!
