Dear Friends and Fellow Virginians,

 

I know it's been quite a while since I've written a formal Compass - but I wanted to send out an update on what's been going on in the fight for liberty and other goings on from the AG's office. 

 

Individual Mandate

 

 As most of you know, our case was heard in the 4th Circuit Court of Appeals last month in Richmond.  At the moment, we are waiting on the judges' decision in that case - and we have little indication of when that decision may come in.  However, our best guess is that we'll know sometime this summer.

 

As we've discussed in a previous Compass, if we win, I suspect that the federal government will NOT appeal to the Supreme Court, rather, they would attempt to drag the case out by seeking what is called "en banc" review.  That means a rehearing by the full 4th Circuit - all 13 active judges. 

 

Once that happens, whichever side loses at that hearing would appeal to the Supreme Court.

 

If we lose, we will likely appeal to the Supreme Court directly, in the hopes of resolving this case as quickly as possible.

 

Doing Well

 

I wanted to let you all know about an award my office received from the National Association of Attorneys General - the national organization of all 50+ attorneys general of the states, territories, and D.C.   

 

Steve McCullough, Senior Appellate Counsel in the AG's office, was praised by the organization for outstanding advocacy in front of the Supreme Court, winning the "Best Brief" award for 2010.

 

This is the second year in the row that attorneys from the Virginia AG's office have received this honor. It goes to show not only the great representation Virginia has had on our ongoing legal actions against the Federal government (and the MANY other cases we try on an ongoing basis which fly under the radar), but the award winning briefs serve as a standard for other AG's offices across the country on how to argue cases before the Supreme Court. 

 

The lawyers and staff in Virginia's Office of the Attorney General often go unnoticed - but their work is essential to the functioning of our state government, to prosecuting and fighting crime and defending our liberties on an ongoing basis.

Speaking of protecting our liberties, please take the time to read an article in today's Washington Times about a potential legal action my office expects to get involved in regarding so-called net-neutrality.

It is important to note that these regulations are egregious violations of federal law.  More shocking is that these regulations are being implemented in the face of a court order to the contrary that is only about a year old!

 

Even putting the policy implications of 'net neutrality' aside - after disrespecting states, federal law and the constitution, this administration is now demonstrating its lack of respect for the last remaining governmental institution in our constitutional system.

A Letter To Your Governor on ICLEI

Hello Everyone,

The concerns of ICLEI/International Council Of Local Enviromental
Initiatives are contintuing to grow. Agenda 21 just made national news
today.

This letter was sent to me by the Faceoff Movement. Feel free to
substitute Governor's name and Attorney General's name where
appropriate then send to the Governors in your state.

Dear Governor Scott,

Sir, the purpose of this letter is to bring to your immediate
attention an issue of great importance to the citizens of Florida and
indeed the nation.

On July 8, 2010 (1) the County Council of Volusia County, Florida
adopted: RESOLUTION 2010-106.

This Resolution authorized membership in the INTERNATIONAL COUNCIL FOR
LOCAL ENVIRONMENTAL INITITIVES-LOCAL GOVERNMENTS FOR SUSTAINABILITY
(ICLEI) with a yearly fee of $2750.00. The ICLEI membership list (2)
includes 41 other local Florida governmental entities as well as over
600 City and County governments across the United States.

The ICLEI Charter, (3) indicates that it acts as an arm of the UN.
ICLEI (4) was founded at the 1990 World Congress of Local Governments
for a Sustainable Future, at the United Nations in New York.

ICLEI's International Goals (5) (5A) include facilitating local
governments in the adoption and implementation of United Nations
Foreign Policies initiatives that the United States Congress have not
approved. Most significant of these are:

AGENDA 21
The UN Convention on Biological Diversity (CBD)
The Kyoto Protocols

ICLEI and the UN have disregarded the, U.S. Congress and the
Constitution of the United States by officially recognizing cities and
local governments as 'governmental stakeholders" at the recent UN
climate talks in Cancun (COP16). ICLEI stated (6) that "Local
governments have to deal with the (climate change) problem…whether
there is a global agreement between national governments or not".
ICLEI has cited (8) "The influence of elections and new governments…"
as obstacles to be overcome in the success of implementing Agenda 21.

ICLEI itself references (7) its association with the UN and the
advancement of Agenda 21 with this quotation from its web site:

"During the Local Government Session at the World Summit in
Johannesburg, South Africa (August 2002) local government leaders from
around the world, as well as representatives from the United Nations
Development Programme (UNDEP) , United Nations Environment Programme
(UNEP), UN-HABITAT and the World Health Organization (WHO), joined
ICLEI in launching Local Action 21 as the next phase of Local Agenda
21 (LA21)".

ICLEI further reveals its mission to implement Agenda 21 at the local
level with this: (8) "The number of cities and towns embracing Local
Agenda 21 planning is continuing to grow as…regional and international
campaigns supporting Local Agenda 21 practices recruit cities and
towns worldwide. In addition, the APEC economies, have committed to
doubling their Local Agenda 21 cities by the year 2003 in cooperation
with ICELI".

The UN influence has also infiltrated the International City/County
Managers Association (ICMA) which is actively training managers in
Smart Growth and Sustainable Development policies which stem directly
from Agenda 21 and the CBD.

The United States Constitution delegates ONLY to the U.S. Senate the
authority to promulgate and implement foreign policy initiatives which
are approved by the Congress.

I respectfully request that you, as Governor of Florida, have Attorney
General Pam Bondi review this issue in light of Article 1, Section 10
of the U.S. Constitution: "No State shall enter into any Treaty,
Alliance or Confederation…" . As local governments are political
subdivisions of the State, they are bound by the same prohibition.

Pursuant to this, a directive should be issued to all State Agencies
and to all Florida local governments advising the immediate
termination of any affiliation with ICLEI and to cease and desist in
any initiative related to ICLEI and the above mentioned UN initiatives
which the Congress of the United States have not adopted..
