It was bad enough that the Florida Legislature passed the REAL ID act in 2008 that placed unnecessary burdens on citizens and required a mountain of paperwork to just renew your driver’s license.

Now the House Transportation and Highway Safety subcommittee just unanimously passed a bill to further dismantle our Fourth Amendment rights to privacy and furthers the goal of a National ID card that we call “Dangerous ID”!

The federal REAL ID Act gives the DHS Secretary unlimited authority as to the purposes for which a REAL ID can be required. These could include banking, buying online, buying groceries, etc.  There is no prohibition against any purpose being authorized by this one individual.

REAL ID came to us in Florida as four of 40+ sections of a 2008 omnibus Highway Safety bill (CS/SB 1992); this new House Bill 1223 is also an omnibus Highway Safety bill. It contains the "electronic authentication" language Sen. Flores tried to slip in to SB 1150 last session, as well as "enhanced" driver’s licenses that will likely contain a Radio Frequency ID (RFID) chip.

Please contact the below members and ask them to pull out any electronic authentication or enhanced driver’s license language - they can do so with an amendment.  

Since the areas of concern are just two sections of a 60+ section omnibus Highway Safety bill, it is far more likely to pass without anyone reading it - just as REAL ID did in 2008.  Add to this the fact that there are “federal dollars” tied to other sections of the bill and legislators will be hesitant to vote against it.

Other states use RFID in their enhanced licenses, and US passports use it as well. These have been easily hacked since at least 2008 with potentially disastrous results.  An RFID reader can be had for under $20, and you only need to be within about 20 feet of the card to read it.

Electronic authentication as worded in HB 1223 is very vague. It includes the term “mediametrics” that no one can define. It does not specify RFID, but it does not prohibit it. It does mention a “security token” which is a device that can be utilized via RFID.

Electronic authentication along with enhanced driver’s licenses are a very bad idea for Florida, as any benefits are greatly outweighed by the risks.

Action Alert: Become Part of a Historic Pro-Life Moment

 

If you’ve been keeping up with the Virginia General Assembly, you celebrated with us Thursday as the Senate Education and Health committee on an 8-7 vote, passed a pro-life bill – the first significant pro-life bill to receive a favorable report from that committee in nine years!  Patroned by Senator Jill Vogel (R-27, Winchester) and Senator Ralph Smith (R-19, Roanoke), SB 484 requires an ultrasound to be performed prior to an abortion and offers the woman the opportunity to view it if she so chooses.

 

Now that bill will be voted on in the full Senate.

 

Please contact your Senator and urge him or her to vote YES on SB 484!

 

We stand amazed at the work God has done to achieve what last year seemed to be the impossible – it all started with the November 2011 election, then Lieutenant Governor Bill Bolling’s tie breaking vote in the Senate which set up a favorable pro-life committee, and on through the vote that took place yesterday.  But the story does not end there.  Our celebration yesterday is still a bit premature as SB 484 must yet overcome its next hurdle – passage on the full Senate floor. 

 

The Family Foundation is cautiously optimistic that SB 484 will pass as it already has bi-partisan support with two democrat co-patrons signed on, Senators Chuck Colgan (D-29, Manassas) and Phil Puckett (D-38, Tazewell).  However, between now and then, you can be sure that NARAL and Planned Parenthood will do all they can to chip away at our bi-partisan support.  That is why we need your help.  The vote on SB 484 is scheduled to take place shortly after noon tomorrow.  Time is of the essence; please contact your senator today.

Dear Chairman Albo and Members of the House Courts of Justice Committee,

HB 1160 which will prevent the use of any Virginia agency or member of the Virginia National Guard or Virginia Defense Force to unlawfully detain a citizen of Virginia on behalf of the United States Government in violation of the Constitution of Virginia. 

Currently the Federal government can detain citizens without a warrant and without a trial who are accused of being terrorists.   This would keep Virginia from collaborating in such activities.

Please do your part in helping to protect your fellow citizens of Virginia and our rights under the Constitution.

HOUSE BILL NO. 631 AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by the House Committee for Courts of Justice on ________________) (Patron Prior to Substitute--Delegate Morris) A BILL to amend the Code of Virginia by adding in Title 20 a chapter numbered 10, consisting of sections numbered 20-166, 20-167, and 20-168, relating to the application of foreign law in Virginia courts. Be it enacted by the General Assembly of Virginia: 1. That the Code of Virginia is amended by adding in Title 20 a chapter numbered 10, consisting of sections numbered 20-166, 20-167, and 20-168, as follows: CHAPTER 10. APPLICATION OF FOREIGN LAWS. § 20-166. Definitions. For purposes of this chapter, unless the context requires otherwise: "Domestic relations" means any matter regarding the affirmance or annulment of a marriage, divorce, custody or visitation of a child, spousal or child support, control or disposition of a child, adoption under Chapter 12 (§ 63.2-1200 et seq.) of Title 63.2, or any other domestic relations matter under Title 16.1 or 20. "Foreign law" means any law, legal code, or system established and used or applied in a jurisdiction outside of the states or territories of the United States. § 20-167. Application of foreign law by courts, etc. It shall be considered a violation of the public policy of the Commonwealth for a court, arbitrator, administrative agency, or other adjudicative, mediation, or enforcement authority in any domestic relations matter to base its ruling or decision in any matter at issue, in whole or in part, on any foreign law, including any ruling or decision to grant comity to any judgment, if the ruling or decision would violate a person's fundamental rights guaranteed by the United States Constitution or the Constitution of Virginia. Any ruling or decision that violates this subsection shall be void and unenforceable. § 20-168. Application of foreign law; exceptions. A. The provisions of this chapter shall not be construed to limit or restrict a person's right to the free exercise of religion guaranteed by the United States Constitution or the Constitution of Virginia. B. Except as otherwise provided in this chapter, the provisions of this chapter shall not apply to any church, synagogue, temple, mosque, religious sect or society, or denomination with respect to matters that are purely ecclesiastical in nature. C. The provisions of this chapter shall not be construed to conflict with any federal treaty or other international agreement to which the United States is a signatory to the extent that such treaty or other agreement controls over the law of the Commonwealth. A useful argument in favor of the bill is that it will

prevent transnational jurisprudence from denying the Constitutional rights of the most vulnerable among us – immigrant women and children. Please refrain from mentioning any one specific system of law based on religion or country.

HOUSE BILL NO. 631 AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by the House Committee for Courts of Justice on ________________) (Patron Prior to Substitute--Delegate Morris) A BILL to amend the Code of Virginia by adding in Title 20 a chapter numbered 10, consisting of sections numbered 20-166, 20-167, and 20-168, relating to the application of foreign law in Virginia courts. Be it enacted by the General Assembly of Virginia: 1. That the Code of Virginia is amended by adding in Title 20 a chapter numbered 10, consisting of sections numbered 20-166, 20-167, and 20-168, as follows: CHAPTER 10. APPLICATION OF FOREIGN LAWS. § 20-166. Definitions. For purposes of this chapter, unless the context requires otherwise: "Domestic relations" means any matter regarding the affirmance or annulment of a marriage, divorce, custody or visitation of a child, spousal or child support, control or disposition of a child, adoption under Chapter 12 (§ 63.2-1200 et seq.) of Title 63.2, or any other domestic relations matter under Title 16.1 or 20. "Foreign law" means any law, legal code, or system established and used or applied in a jurisdiction outside of the states or territories of the United States. § 20-167. Application of foreign law by courts, etc. It shall be considered a violation of the public policy of the Commonwealth for a court, arbitrator, administrative agency, or other adjudicative, mediation, or enforcement authority in any domestic relations matter to base its ruling or decision in any matter at issue, in whole or in part, on any foreign law, including any ruling or decision to grant comity to any judgment, if the ruling or decision would violate a person's fundamental rights guaranteed by the United States Constitution or the Constitution of Virginia. Any ruling or decision that violates this subsection shall be void and unenforceable. § 20-168. Application of foreign law; exceptions. A.
