HB 1468 creates a cause of action in a case where a person is deprived of their personal property (asset forfeiture) by police initiated taking in a case where the accused is then later acquitted or the case is resolved without a conviction. The Commonwealth would be liable for damages in a case such as this. The 4th Amendment and Virginia Constitution require just compensation when government officials in the course of their duties take private property.
HB 1468 will be heard in the Criminal Laws Subcommittee tomorrow afternoon (January 21st).
Please contact the members of the Courts of Justice Criminal Laws Subcommittee and ask them to support this legislation to protect personal property rights.
