My HB 481 requires that if a locality releases an illegal alien before the end of their term of incarceration and the locality has received a request from ICE to detain that individual, that the locality may be sued by individuals injured or harmed by such alien for any acts committed by such alien through midnight of the day they were scheduled to be released.  
 
On July 1, 2015, Kate Steinle and her dad were walking on a crowded waterfront in San Francisco.   She left this life that day because she was shot in the back by Sanchez Lopez, who was in America illegally, who had several prior felony convictions and who previously had been deported five times back to Mexico.
 
The U.S. Immigration Customs Enforcement had requested that San Fransisco sheriff Ross Mirkarimi detain Mr. Lopez for possible deportation.   Sheriff Mirkarimi declined to honor the detainer request from ICE because the City of San Francisco has a policy of providing such individuals with what they call "sanctuary" from federal requests for deportation and because the Sheriff did not recognize ICE detainers as legal documents.

A report from ICE shows that several Virginia localities have also released prisoners that they had ICE detainer requests for.  Many of these prisoners had previous arrests.

 
My HB 481 was held over today to deal with a concern and will be heard on the floor of the House in the early afternoon tomorrow.  Please contact your Delegate by noon, TOMORROW, Wednesday February 3rd and ask them to support the bill.
