CoLA PRIORITY LEGISLATION - 2013 SCORECARD BILLS

Only 2 days Left to Crossover

Please start leaving voice mails and sending emails to your own legislators
as soon as possible to help kill these bad bills and to ask for support for
the good ones. All Delegates and Senators are voting - these bills are on
the floor!

CALL YOUR DELEGATE:

WE MUST KILL THIS BILL

1) HB2048 - OPPOSE: Gives unprecedented power to DEQ Ask your Delegate: Has
he read this 59 page monster of a substitute? Are they voting on a bill they
have never read? ... "Or do they have to pass it to see what's in it!" ...
A citizen can currently do nothing with private property without Government
permission. With this legislation, if 'they' decide that your property is
involved in stormwater runoff, they can charge civil penalties. Do you have
a roof?



Ask them: "Where is the requirement for GA approved implementation plans
based on 1) a cost benefit analysis; 2) a NEPA study 3) true (not modeled)
current science"?

SUMMARY AS INTRODUCED: Consolidation of water quality programs. Moves the
water quality programs currently administered by the Department of
Conservation and Recreation to the Department of Environmental Quality. The
Department of Environmental Quality and the State Water Control Board will
have oversight of water quality planning and laws dealing with stormwater
management, erosion and sediment control, and the Chesapeake Bay
Preservation Areas. The composition of the Virginia Soil and Water
Conservation Board is changed, reducing the number of voting members from 12
to seven, and the Department of Environmental Quality is assigned
responsibility for staffing the Board. The Virginia Soil and Water
Conservation Board will continue its oversight responsibilities of the soil
and water conservation districts and of resource management planning. The
Board of Conservation and Recreation will be responsible for administration
of the flood prevention and dam safety laws.


It is impossible to read and understand legislation like this in such a
short time frame. These are a few questions from our reading of the 59 page
substitute.

* In charge of water quality? Per Dr Charles Battig; EPA Clean water
standards are now cleaner than rainwater
* Nonpoint Source Pollution is defined in this bill as storm water
runoff. Didn't our AG just win a case? ... Didn't the judge rule that
"storm water is not a pollutant"? If this bill passes it will become a
pollutant according to VA law! If the runoff from your roof or your driveway
doesn't meet their yet to be defined standards they will be able to charge
you civil penalties
* This bill allows them to go on any property, public or private, to
do inspections
* Considering the states limited resources, haa all the Point Source
Pollution been cleaned up?



2) HB1430 - SUPPORT: 'Boneta Bill' - Protects the 'Right to Farm' for small
farmers. Ask your delegate to take out the reenactment clause and vote YES!
Final vote for passage is Monday. The Farm Bureau, VACO and PEC will fight
us to the bitter end with all they've got!

Enough calls from us and they won't win! WE VOTE!!

CALL YOUR SENATOR:

1) SUPPORT SB1256, Photo ID required to vote Ask your Senator to take a
stand against VOTER FRAUD. We have a Republican majority. There is no
acceptable excuse for not voting for the most basic way to protect our right
to fair elections.

This will likely be a 20-20 vote in the Senate

As an ordinary citizen concerned about the voter fraud that you know exists
in VA, Please call Lt Governor Bolling and ask him to vote YES to break any
tie on Photo ID to vote

2) Ask if he/she voted for SB1279 (Companion to HB2048; see above) Ask
them if they read all 93 pages of the Senate version of this monster that
gives enormous power to DEQ before they voted on it? No legislation in this
General Assembly will do more to destroy property rights. Tell him you
expect him to read the 59 page substitute for HB2048 if it passes the House
and vote NO. If your Senator voted against SB1279, please thank him and ask
him to vote NO if the HB2048 substitute crosses over from the House.

FYI....This was the final vote for passage

NAYS--Black, Carrico, Garrett, Martin, McDougle, McWaters, Newman,
Obenshain, Reeves, Smith, Stanley, Vogel--12.

Please, thank these Senators who voted against SB1279 and ask them to vote
no on HB2048 if it crosses over
