My HB 1160 addresses a provision of 2012 federal Defense Authorization Act (December 2011) under which American citizens may be indefinitely detained, incarcerated, not presented with charges and denied counsel based on an accusation by federal agents of collaboration with or support of terrorists.

The 2012 NDAA and the 2001 Authorization of Military Force have, in effect, suspended the Sixth Amendment to the US Constitution. 
 
HB 1160 may be voted on by the Virginia state senate on Monday Feb. 27.   Concern has come from Forbes Magazine, the ACLU Nationwide, the John Birch Society and others concerned with civil liberties.
 
President Obama, when he signed the bill, said he would not use the power granted to him by the bill, but since the Department of Homeland Security has categorized people who oppose abortion, or who favor the Second Amendment or even sound monetary policies as persons who must be watched closely, I decided to introduce HB 1160 to protect the constitutional rights of Virginians.
 
HB 1160 will prevent the use of any Virginia agency or member of the Virginia National Guard or Virginia Defense Force to assist in any way to unlawfully detain a citizen of Virginia on behalf of the United States Government in violation of the U.S. and Virginia Constitutions.
 
 
HB 1160 passed the House of Delegates by a vote of 96-4 and passed the Senate Courts of Justice Committee 8-4 with three abstentions.  The measure will be up for a vote on the floor of the Virginia Senate tomorrow, Monday, February 27, sometime after 12:00 noon.
 
Please urge your own state Senator to vote in favor of HBB 1160.  Since the Governor had previously sent a message to the House of Delegates Subcommittee Chairman that he does not like my bill, unless there is a groundswell of support for it, it may not survive the final vote in the full Senate despite its already passing the House Subcommittee, full Committee, full House floor and Senate Committee.
 
Please pass this email to your family and friends and ask them to also contact their own State Senator to vote in favor of HB 1160.
